The circumstances surrounding today’s entire political, legal and judicial process do not provide an enabling environment for the drafting or referendum on the country’s supreme legal text (the Constitution).
At the political level, the President has seized full power. He shall amend the legal texts as he sees fit and whenever he wishes, dissolving the councils and bodies, deciding on their composition, defining their powers and submitting them to his authority.
On the legal front, almost all elements of the rule of law have been eliminated in the absence of basic principles: legal certainty, hierarchy of legal texts, clarity and stability of provisions, and the guarantee of fundamental rights such as the rights of defence and the right to a fair trial...
At the judicial level, after the removal of the 57 judges, the announcement of a strike in all courts and the denial of the right of judges exempted from challenging the revocation order to review the referendum process… the manipulation of trials before the courts, this will affect this process and its credibility or even its acceptability, which will have a negative impact on the legitimacy and consequences of the referendum process!
In this context, the Tunisian Association for the Defense of Individual Freedoms, continues its monitoring work undertaken since July 25, 2021, and presents its periodic report covering the period March 25-June 25, 2022, during an evening debate hosted by Wahid Ferchichi, with the participation of Saida Garrach and Yassine Nabli.
About the panelists
Wahid Ferchichi
Professor of public law at the University of Carthage, director of the department of public law and political science at the Faculty of Political and Social Sciences of Tunis, where he co-chairs the master's degree in human rights and coordinates the legal clinic on gender-based violence. Wahid Ferchichi is the honorary chairman of the Tunisian Association for the Defence of Individual Freedoms.
